Terms of Service

1Scope

These Terms govern the use of Drank It! (published in Japan as 「呑んだよ！」, "the Service") and the relationship between us as its operator and you as a user. By using the Service you agree to these Terms.

2Eligibility and age

1. You may use the Service only if you are of legal drinking age in the country or region where you live. In no case may anyone under 18 use the Service.
2. You are asked to confirm that you meet the age requirement when you register. If you register on the basis of a false confirmation, we may suspend or delete the account without notice.
3. If we reasonably believe that a user is under the applicable age, we may suspend the account.

3Your account

1. You are responsible for keeping your account credentials safe.
2. Creating multiple accounts in order to impersonate someone or to manipulate rankings and votes is prohibited.
3. You can delete your account at any time from the app's settings. Your posts become private and your handle and email address are released. See the Account & data deletion page.

4Content you post

1. You confirm that you hold the rights necessary to post the content you upload.
2. You grant us a non-exclusive licence to use your posted content in order to operate, improve and promote the Service. You keep ownership of your content.
3. Information about the drinks you post is used in the statistics and displays on that drink's page.

5Prohibited conduct

You must not:

• post anything that encourages, condones or glamorises drinking by people below the legal drinking age;
• promote or praise pressuring others to drink, including drinking games intended to force rapid consumption;
• suggest or encourage drink-driving;
• encourage excessive drinking or behaviour likely to cause alcohol poisoning;
• defame, harass, threaten or discriminate against other users;
• post obscene or violent content, or content contrary to public decency;
• publish other people's personal information without permission, or impersonate anyone;
• infringe intellectual property rights;
• send spam, indiscriminate advertising, or automated bulk posts;
• break the law or help others to do so;
• interfere with the operation of the Service or attempt unauthorised access.

6Reports and enforcement

1. You can report a post, comment or account from inside the app.
2. We review reports and, where we consider it necessary, hide the content, suspend the account or take other measures.
3. We are not obliged to reply individually to the person who filed a report.
4. Repeatedly filing false reports in order to harass someone may itself lead to restrictions on the reporter's account.

7Blocking

You can block another user. Once blocked, neither of you sees the other's posts or profile, and any follow relationship is removed.

8Accuracy of drink information

Some of the drink information in the Service is generated automatically by AI and may differ from the real product. Always check the label and the producer's official information for alcohol content, ingredients and allergen information. We do not warrant that drink information is accurate or complete.

9Points, ranks and badges

Points, ranks and badges exist only as a status display to make keeping a record enjoyable. They have no monetary value and cannot be exchanged for money, transferred, or redeemed for prizes. They are not intended to make anyone compete on how much they drink, and there is a daily cap on how many points can be earned.

10Liability

1. Except in cases of our wilful misconduct or gross negligence, we are not liable for loss arising from use of the Service.
2. We accept no liability for harm to health or accidents arising from drinking.
3. We are not obliged to become involved in disputes between users.
4. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence.

11Changes to the Service

We may change or discontinue the Service without prior notice.

12Changes to these Terms

We may amend these Terms. The amended version takes effect when it is posted on this page.

13Governing law and your local rights

These Terms are governed by the laws of Japan, and the court with jurisdiction over the operator's location is the exclusive court of first instance for disputes about the Service.

If you are a consumer, this does not deprive you of the protection of the mandatory consumer law of the country where you live, nor of your right to bring proceedings in your local courts where that law gives you the right to do so.
